Resumo
O artigo discute a administração da justiça na primeira metade do século XIX no Império do Brasil a partir da análise da divisão entre os novos poderes políticos constitucionais, e dos problemas que envolveram a criação e funcionamento de cargos e instituições vinculados ao judiciário. Entre eles, os vários e recorrentes conflitos de jurisdição, a amplitude de questões circunscritas na pasta da Justiça, o controle e manutenção da ordem pública – com a imbricação entre as funções judiciárias e policiais, e a utilização de força armada por parte de seus agentes. Defendemos que os impasses na implementação de um modelo liberal de justiça – que previa, ao mesmo tempo, sua independência e controle dos magistrados e tribunais –, devem ser vistos à luz da manutenção do funcionamento de uma cultura jurisdicional, bem como diante da complexificação das ações para aplicação da lei pelos agentes da justiça.

Abstract
This paper discusses the administration of justice in the Brazilian Empire during the first decade of the Nineteenth century, based on the analysis of the division between the new constitutional, political powers and the problems involving the creation and operation of offices and institutions linked to the Judiciary. Among the latter, the various and recurring conflicts of jurisdiction, the wide range of issues circumscribed within the Office of Justice, the control and maintenance of public order – with the intimate relationship between legal and police actions and the use of armed forces by their agents. In our view, the impasses on the implementation of a liberal model of justice – that at the same time anticipated its independence and the control of magistrates and courts of law – would demonstrate that operation of the legal culture should be maintained, due to the complexity of actions concerning the application of the law by legal agents.
