Resumo
A influência da pandectística no Código Civil de 1916 é habitualmente reconhecida no meio acadêmico. O propósito da presente pesquisa foi verificar até que ponto a adoção de certas características desta doutrina seria suficiente para atestar ser o Código Civil uma criação pandectista. Para realizar tal tarefa, foram analisados dez elementos da civilística, comparando as diferentes soluções dadas pela pandectística, pelo direito romano tradicional, pelo jusnaturalismo e pelas codificações (ALR, ABGB, BGB, Code Civil). Verifica-se que a influência da doutrina pandectista no Código Beviláqua é menor do que se supõe. Concluiu-se que o Código Civil de 1916 se apresenta mais como resultado da discussão internacional, em sua época, sobre a legislação na área do direito civil, do que como fruto da pandectística.

Abstract
The influence of Pandectistics on the Brazilian civil code of 1916 is commonly acknowledged by the academic community. The aim of this paper is to assess if the presence of certain elements of said doctrine suffice to assert that the Beviláqua´s civil code is a pandectistic creation. For this purpose, ten characteristic features of civil law were analyzed and compared to the different solutions offered by pandectistics, the traditional Roman law, jusnaturalism and a number of codifications (ALR, ABGB and BGB, civil codes). The research reveals that the impact of the pandectistic doctrine on Beviláqua’s civil code is smaller than usually assumed. The paper concludes that the civil code of 1916 is rather the result of the international debates back then over civil law legislation.
