Resumo
Este artigo analisa o projeto de estatuto da Corte Permanente Internacional de Justiça elaborado por Clóvis Beviláqua. Assim, busca compreender a sua concepção de justiça internacional e se ela guarda coerência com os princípios de Direito Internacional defendidos por Rui Barbosa na II Conferência da Haia de 1907. Para tanto, foram empregadas três técnicas de análise. Primeiro, procurou contextualizar-se o pensamento jusinternacionalista de Beviláqua. Depois, o projeto foi interpretado à luz dos demais escritos do autor sobre justiça internacional, o que inclui os dois tomos do livro Direito Público Internacional, dois pareceres e uma conferência proferida no Instituto dos Advogados do Brasil. Por fim, empregou-se a doutrina irenista como ferramenta compreensiva do projeto de Beviláqua. As mais variadas propostas do início do século XX sobre a organização da sociedade internacional compartilham ou um acolhimento pleno ou um repúdio absoluto à concepção irenista de justiça internacional. A pesquisa utilizou o método indutivo de abordagem, e as suas fontes primárias foram as mencionadas obras de Beviláqua, e as secundárias as das suas principais referências.

Abstract
This paper analyses the draft of the statute of the Permanent Court of International Justice written by Clóvis Beviláqua. Our aim is to comprehend Beviláqua’s conception of international justice and whether it is coherent with the principles of International Law upheld by Rui Barbosa in the Second Hague Conference of 1907. For this purpose, we used three analysis techniques. We first sought to contextualize Beviláqua’s international law thought. We then interpreted the draft within the context of other writings by the author on international law, including the two volumes of his book International Public Law, two expert opinions and a lecture he delivered at the Brazilian Lawyers Institute. Finally, we applied the irenic doctrine as a way of understanding Beviláqua’s draft. The most diverse proposals of the early 20th century aimed at organizing the international society are either completely in favor or completely against the irenic notion of international justice. We follow in our analysis an inductive approach using Beviláqua´s aforementioned works as primary sources, and, as secondary sources, the main references made to him.
