Resumo
Partindo da premissa no sentido de que a história dos conceitos jurídicos (ou a história do pensamento jurídico) tem enormes potencialidades de análise, este trabalho retoma a produção do jurista brasileiro Augusto Teixeira de Freitas – e mais particularmente sua “Consolidação das Leis Civis”, de 1857 – para enquadrá-lo como típico representante da cultura jurídica do século XIX brasileiro: numa tensão e ecletismo próprios de um período que ainda oscila entre características pré-modernas e modernas. Mostra-se, ao final, como o jurista brasileiro, no trabalho referido, inclusive teve um papel de “inventor” na interpretação e compilação que fez da legislação civil do período.

Abstract
Based on the premise that the history of juridi- cal concepts (or the history of juridical thinking) has great potential of analysis, this paper reviews the intellectual production of Brazilian jurist, Augusto Teixeira de Freitas – focusing on his “Consolidation of Civil Laws” of 1857 – to acknowledge him as a typical representative of the juridical culture of Nineteenth century Brazil: a tense and eclectic period still undefined between pre-modern and modern characteristics. At the end, the paper also shows how the Brazilian jurist, in the aforementioned work, also played the role of “inventor” as he interpreted and compiled the period’s civil legislation.
