Resumo
O trabalho investiga o pensamento jus-filosófico de Clóvis Beviláqua (1859-1944), ao final do sec. XIX , através da análise de sua obra Juristas Philosophos (1897). O objetivo da análise é detectar as principais concepções da filosofia do direito que, então, influenciavam o autor do anteprojeto do 1o. Código Civil Brasileiro (1916). A hipótese de trabalho se cinge ao fato de que tal conhecimento pode abrir caminhos para a compreensão de questões importantes, ligadas ao estudo da história do direito no Brasil, da qual Clóvis Beviláqua é um partícipe privilegiado. A análise de conteúdo da obra propiciará o estudo da evolução histórica do direito, das várias escolas jurídicas que influíram nesta evolução e da metodologia adotada pelos diferentes jusfilósofos estudados por Clóvis em seu livro. O cientificismo reinante na “Escola do Recife”, da qual Clóvis foi um dos principais membros, vai dar margem a interpretações epistemológicas. Abstract
This article will investigate the jus-philosophical thought of Clovis Bevilaqua (1859-1944) at the end of the Nineteenth century, through the analysis of his work, Philosopher Jurists (1897). The purpose of this analysis is to identify the existing, principal philosophical concepts of Law that influenced the author of the First Brazilian Civil Code draft (1916). The hypothesis of this paper deals with the fact that such knowledge might open the way to the understanding of important issues concerning the studies of the history of Law in Brazil, of which Clovis Bevilaqua was a privileged participant. The contents analysis of this work will facilitate the study of the historical evolution of Law, of the various Law schools that influenced that evolution and of the methodology used by the different jusphilosophers studied by Clovis Bevilaqua in his book. The scientism dominating the “School of Recife”, where Clovis Bevilaqua was one of its prime members would lead to epistemological interpretations. The end purpose – pursued by Clovis – is to reach a scientific concept of Law.
