Resumo
O Código Criminal do Império do Brasil, de 1830, previa em seus artigos 113, 114 e 115 o crime de insurreição, que penalizava os escravos que tentassem obter sua liberdade por meio da força, bem como terceiros que os auxiliassem na consecução de seus intentos. A partir de dicionários e documentos dos séculos XVII, XVIII e XIX (da Espanha, França, Inglaterra, Estados Unidos e Brasil), e também da historiografia pertinente, o presente artigo visa recuperar de que maneira esse tipo penal foi incoporado ao referido código, considerando-se que a palavra insurreição (em português) não fora ainda dicionarizada até inícios do XIX, e que ela aparecia em documentos brasileiros da década de 1820 com um sentido completamente distinto daquele do código.

Abstract
The Brazilian Empire’s 1830 Criminal Code anticipated in its articles 113, 114 and 115, the crime of insurrection, that punished slaves who attempted to obtain their freedom through force, and also third parties who helped them in their attempt. Based on dictionaries and documents dating from the Seventeenth, Eighteenth and Nineteenth centuries (from Spain, France, England, USA and Brazil), as well as pertinent historical writings, this paper aims at identifying how that punishment was incorporated into the referred Code since the word insurreição2 (in Portuguese) had not yet been included in dictionaries until the beginning of the Nineteenth century and that it appeared in Brazilian documents in the 1820s with a totally different meaning than that in the Code.
