Resumo
O presente artigo objetiva examinar, à luz da dicotomia conceitual entre “Lei Orgânica” e “Constituição”, a dimensão constitucional da Revolução Pernambucana de 1817. Com base na história conceitual de Reinhart Koselleck, defendemos que a “Lei Orgânica de 1817” aproxima-se semanticamente do moderno conceito de “Constituição”, já que contém diversos elementos comuns, a exemplo do caráter legitimador e transformador das relações sociais bem como da inovação na ordem jurídica e política. No entanto, a própria Lei Orgânica de 1817 não se autorreconhece como uma legítima “Constituição”, porquanto se reveste de caráter provisório, tendo em vista que a Revolução Republicana necessitava, desde os primeiros momentos, consolidar-se territorialmente e legitimar-se politicamente.

Abstract
In the present article we examine the constitutional dimension of the Pernambuco Revolution of 1817 in the light of the conceptual dichotomy between “Organic Law of 1817” and “Constitution”. Departing from Reinhart Koselleck’s history of concepts, we argue that the “Organic Law of 1817” is, on one hand, very semantically close to the modern concept of “Constitution”, since both contain several common elements, such as the legitimating and transformative character of social relations and the innovation in the legal and political order. On the other hand, the Organic Law of 1817 does not recognize itself as a legitimate “Constitution”, due to its provisional character, and also due to the fact that the Republican Revolution would have had to consolidate itself territorially right from the beginning in order to be politically legitimate.
